Strengthening Tobacco Taxation in Kenya: Evolution, Challenges and Opportunities for Reform

This study examines the evolution and effectiveness of tobacco taxation policy in Kenya within the broader context of public health and economic development. Tobacco use remains a major preventable health risk, responsible for approximately 12,000 deaths annually and imposing economic costs estimated between $544.4 and $756.2 million in 2021. Beyond its health burden, tobacco consumption undermines productivity and household welfare, reinforcing the need for strong fiscal and regulatory interventions.

The report analyses key reforms in Kenya’s tobacco tax system from 1993 to 2025, highlighting shifts between ad valorem, specific, and hybrid excise structures. While the introduction of a uniform specific excise tax in 2015 aligned with global best practices, subsequent reversals and policy inconsistencies—often influenced by industry pressure—have weakened the effectiveness of taxation as a public health tool. Recent efforts, including inflation adjustments and expanded taxation to emerging products such as e-cigarettes, signal progress but remain insufficient.

Drawing on the Tobacco Excise Tax Simulation Model (TETSiM), the study identifies persistent gaps in tax structure, affordability control, and revenue optimization. It concludes that strengthening tobacco taxation offers a critical opportunity to reduce consumption, improve health outcomes, and enhance domestic resource mobilization in Kenya.
